These Terms and Conditions (“Terms”) govern your access to and use of the services provided by Lead Lynx LLC, doing business as ISA REALTOR (“we”, “us”, “our”). By subscribing to or using our services, you (“Client”, “you”, or “your”) agree to be bound by these Terms.

1. Services Provided

We offer the following services:

• ISA Services: For a flat fee of $150 per month, we provide trained Inside Sales Agents (ISAs) who will contact your uploaded leads and attempt to set appointments on your behalf.
• Free CRM Access: As part of your subscription, we provide complimentary access to our proprietary Customer Relationship Management (CRM) system. The CRM includes tools for contact management, calls, SMS, emails, websites, funnels, automations, and more.
• Communication Wallet: Clients are required to maintain a prepaid wallet to cover the cost of phone and messaging usage. This includes:
  • Outbound calls and SMS
  • Email campaigns
  • Phone number rental fees
  • Number/email validation
  • Toll-free verification and A2P messaging setup (if applicable)

2. Payment and Billing

• ISA Service Fee: Billed monthly at $150. This fee is non-refundable, regardless of the outcomes or volume of appointments scheduled.
• Wallet Recharges: Clients may add funds to their wallet to cover usage-based charges. These funds are used as services are consumed.

3. Refund Policy

• ISA Service Fee: Non-refundable once paid.
• Wallet Funds: Unused wallet balance is refundable upon service cancellation. To request a refund, you must contact us directly, and the remaining balance will be processed back to your original payment method within a reasonable timeframe.
• No Performance-Based Refunds: We do not issue refunds based on lead engagement, lack of appointments, or perceived service effectiveness. You are responsible for lead quality.

4. Lead Submission and Responsibility

• Client-Supplied Leads: You are solely responsible for providing valid, opt-in leads for our ISA team to call.
• Compliance: You must ensure your leads comply with all applicable laws and regulations, including but not limited to Do Not Call (DNC) lists and telemarketing laws.

5. Use of CRM Platform

• Access Rights: You are granted limited, non-transferable access to the CRM for the duration of your active subscription.
• Prohibited Use: You agree not to misuse, copy, reverse-engineer, or resell any part of the CRM or its services.

6. Account Termination

We reserve the right to terminate your account without notice if:

• You breach these Terms;
• Engage in fraudulent or illegal activity; or
• Use the system in a way that harms our operations or reputation.

Upon termination:

• Access to CRM will be revoked immediately.
• Any unused wallet funds will be refunded upon request.
• No refund will be issued for the current month’s ISA service fee.

7. Limitation of Liability

ISA REALTOR / Lead Lynx LLC is not liable for:

• Lack of productivity or conversions from ISA outreach
• Loss of revenue, opportunities, or data
• Any indirect or consequential damages arising from use of the service

8. Changes to Terms

We reserve the right to update or modify these Terms at any time. Continued use of the service after changes constitutes acceptance of the updated Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of laws principles.
